“Trust and Security at the Heart of the EU Digital Decade” – European Union

The EU Cyber Strategy is supported by a range of new rules to make physical and digital entities more resilient. Released in December 2020, this will bolster and serves as a key component of the overarching “Shaping Europe’s Digital Future” strategy.

 

The objective is clear, to enhance collective resilience against cyber threats and help ensure that all citizens and businesses can benefit from a safe digital society. This encompasses areas such as:

  • Energy
  • Transport
  • Banking
  • Financial Market Infrastructure
  • Health & Pharma
  • Drinking Water
  • Waste Water
  • Digital Infrastructure
  • Public Administration and even Space!

 

This approach facilitates EU leadership to step up initiatives around standards and cyber diplomacy with partnerships to support a cyber ecosystem that is global, open, secure, grounded in the rule of law, human rights and fundamental freedoms of democratic values.

All of this is powered by a number of forthcoming pieces of legislation; the CER (Critical Entities Resilience) directive and the updated NIS 2 (Network Information Systems) directive. Game changers!

 

Excuse the pun but the initial impact may be felt from DORA. That is the Digital Operational Resilience Act which is imminent and aims to ensure that all entities in the financial system have the appropriate safeguards in place to mitigate cyber attacks. This legislation will require firms to ensure that they can withstand all types of ICT (Information Communications Technology) related disruptions and threats. This is essentially the European Union’s attempt to streamline the third-party risk management process across financial institutions. DORA will require all organisations to implement cyber risk management strategies and third-party risk management programs.

 

This new regulation that will require banks and firms in the global financial industry to ensure their third-party risk management programs includes cybersecurity requirements in particular with the critical ICT service providers they are working with. All financial service firms and ICT vendors despite size or complexity will be included within DORA’s guidelines.

 

DORA has bite! DORA provides administrative penalties on third party providers for non-compliance of 1% of average daily worldwide turnover. Member states can also choose to impose harsher sanctions under national law.

 

Regulations such as DORA when adopted will become law in Ireland within 18 months. They aim to support an increased level of cyber resilience across the public and private sector.  The overarching EU strategy also has a focus on securing the next generation of networks, 5G and beyond.

 

Other EU strategy initiatives include the “Cybersecurity Shield”, powered by artificial intelligence (AI)  and it will be able to detect signs of cyberattack early enough and to enable proactive action, before damage occurs. There will also be “Digital Innovation Hubs” to support small and medium sized businesses and member states will even have access to what is referred to as the “EU Cyber Diplomacy Toolbox”.

 

All of these initiatives are being supported with an unprecedented level of investment of over €4.5 billion. There are measures in place to ensure that a major portion goes to SME’s.

Paul C Dwyer is recognised as one of the world’s foremost experts on cyber security, risk and privacy. As CEO of Cyber Risk International he specialises in corporate and enterprise security, development of cyber defence programs, and business operations protection for CRI clients. As founder and President of the ICTTF International Cyber Threat Task Force he is an advocate for diversity in the industry and leads a community of over 30,000 with a common goal to defeat cyber evil.

Certified an industry professional by the International Information Security Certification Consortium (ISC2) and the Information System Audit and Control Association (ISACA). Approved by the National Crime Faculty and the HTCN High Tech Crime Network. He has worked extensively around the world his diverse career spans more than 30 years working with military, law enforcement and the commercial sector.

Paul is a fellow of the Irish Computer Society and a member of a number of industry groups including the IoD (Institute of Directors), IIEA (Institute of International and European Affairs) and the IRM (Institute of Risk Management). He holds a Diploma in Corporate Governance from the Corporate Governance Institute and is Certified by Harvard as a Higher Education specialist.
